Many people pleads guilty for crimes that they haven’t committed due to lack of knowledge or funds. So they take a plea deal confessing to a crime that they did not commit in hopes of a lesser sentence .Should their confession be thrown out due to the lack of counseling, ( such as having a lawyer present)
No, but if they don’t have funds for a lawyer the court normally appoints one here in the US. If someone’s confession was thrown out due to lack of legal counsel, then it would be the same for someone who confessed and really did commit the crime.

True, but a person can feel scared, overwhelmed and pressured/trapped into confessing to a crime that he/she did or did not commit. How many times has a court appointed attorney encourage someone to take a deal whether they are guilty or not.
